1. ACCEPTANCE OF TERMS

By downloading, installing, or using the Creative Minds Development Center Parent App (the “App”), you (“User” or “Parent/Guardian”) agree to be bound by these Terms and Conditions (the “Terms”) in full. If you do not agree, you must not use the App.

Continued use constitutes acceptance of any future updates to these Terms made by Creative Minds Development Center (“the Center”).

2. PURPOSE OF THE APPLICATION

The App is an internal communication tool intended exclusively for parents or legal guardians of children enrolled at Creative Minds Development Center.

The purpose of the App is to support transparent communication between the Center and families, including:

Daily activity summaries
Notifications and urgent alerts
Photos and classroom updates
Pickup and drop-off coordination
Event and meal schedules

The Center may update or modify App features as necessary.

3. USER REGISTRATION AND ACCESS

To use the App, the User must register and provide accurate information.

Personal and non-transferable
Not to be shared with others

The User is responsible for protecting their login information and notifying the Center if unauthorized access is suspected.

4. RESPONSIBILITY FOR ACCOUNT PRIVACY

The User is fully responsible for maintaining the confidentiality of their account and the security of the device used to access the App.

The Center is not liable for unauthorized access resulting from:

Shared passwords
Lost or stolen devices
Negligent account or device management

The User must notify the Center if the device or credentials are compromised.

5. INFORMATION COLLECTED

The App may collect:

Parent/Guardian Information

Name
Email: pmontanez@creativemindschicago.com
Phone number
Emergency contact information

Child Information

Name
Date of birth
Daily care and activity logs
Health or allergy information (if provided)
Authorized pickup contacts

Device Information

Device model and operating system
IP address
Push notification token

This information is used exclusively for internal communication and child safety.

6. PURPOSE OF DATA USE

Data is used for:

Communication between staff and the family
Child drop-off and pick-up verification
Emergency alerts
Activity and progress reporting
Licensing and legal compliance

Data is not sold or used for commercial advertising.

7. COPPA COMPLIANCE (U.S. FEDERAL LAW)

The Center complies with the Children’s Online Privacy Protection Act (COPPA).

The App is intended for parents/guardians only.
No child directly submits information through the App.
Parents may request access, correction, or deletion of their child’s data at any time.

8. CONFIDENTIALITY AND DATA SECURITY

The Center will not sell or disclose personal or child data, except:

When required by law or court order
To protect the immediate safety of the child
To enable system functionality under confidentiality agreements

Data may be stored using encrypted or secured systems where applicable.

9. COMMUNICATION THROUGH THE APP

Users agree to receive communication through the App regarding:

Daily updates and activity summaries
Safety and health alerts
Important administrative notices

Users should check the App regularly.

10. INTERNAL USE ONLY – NO REDISTRIBUTION

All content in the App, including photos and messages, is confidential.

Users agree not to:

Screenshot, forward, or share photos that include other children
Post App content on social media
Share internal communication outside their household

Violation may result in account suspension and/or legal action.

11. LIABILITY FOR LOST OR SHARED PASSWORDS

The Center is not responsible for unauthorized access caused by:

Shared passwords
Lost or stolen devices
Devices without proper security enabled (PIN, biometrics, etc.)

Users must report compromised accounts immediately to reset access.

12. LIMITATION OF LIABILITY

The Center does not guarantee uninterrupted App service and is not responsible for:

Device malfunction
Internet or network issues
Temporary outages
Indirect or consequential damages

The App supports communication but does not replace speaking directly with staff when urgent matters arise.

13. INTELLECTUAL PROPERTY

All design, content, text, and media in the App are the property of Creative Minds Development Center and may not be reproduced or distributed without permission.

14. MODIFICATION OF TERMS

The Center may update these Terms. Continued use of the App after notification indicates acceptance of changes.

15. DATA RETENTION AND DELETION REQUESTS

Parents/Guardians may request:

Review of personal or child data
Correction of inaccurate data
Deletion of data where legally permissible

17. AGREEMENT AND CONSENT

By using the App, the User confirms:

They are the child’s legal parent/guardian
They have read and understood these Terms
They consent to internal use of data for childcare, communication, and safety

If the User does not agree, they must discontinue use of the App.

Terms and Conditions of Use
